These Terms & Conditions (“Terms”) govern all use of services provided by Access Ability (“we”, “us”, “our”), including exercise physiology, physiotherapy, aged‑care wellness programs, NDIS services, mobile sessions, assessments, and all content on this website.

By accessing our website, booking a service, or participating in a session, you agree to these Terms.

2. Nature of Services

Access Ability provides:

• Exercise physiology
• Physiotherapy
• Falls‑prevention programs
• Aged‑care wellness services
• NDIS support for self‑managed and plan‑managed participants
• Mobile and on‑site sessions


We do not provide emergency medical services or medical diagnosis.

3. Client Responsibilities

You agree to:

• Provide accurate and complete health information
• Follow all safety instructions during sessions
• Seek medical clearance when recommended
• Inform us of any changes to your health
• Ensure your home or facility environment is safe for mobile sessions


Failure to disclose relevant medical information may limit our ability to provide safe and effective services.

4. Payment Terms

4.1 General Clients

Payment is due at the time of service unless otherwise agreed.

4.2 NDIS Participants

We work with:

• Self‑managed participants
• Plan‑managed participants


You are responsible for ensuring your plan has sufficient funding.
We do not guarantee NDIS funding approval or reimbursement.

4.3 Late or Failed Payments

Unpaid invoices may result in:

• Suspension of services
• Debt recovery action
• Administrative fees

5. Cancellations & Rescheduling

To protect our time and ensure fairness:

• 24 hours’ notice is required for cancellations or rescheduling
• Sessions cancelled with less than 24 hours’ notice may be charged at 100% of the fee
• Non‑attendance without notice will be charged in full


NDIS participants will be charged in accordance with the NDIS Pricing Arrangements.

6. Mobile Service Conditions

You agree to provide a safe environment for mobile sessions, including:

• Clear floor space
• Adequate lighting
• No hazards (pets, clutter, wet floors, etc.)


We reserve the right to refuse or stop a session if safety is compromised.

7. Limitation of Liability

To the maximum extent permitted by Australian law:

• We are not liable for injuries, losses, or damages arising from misuse of exercises, failure to follow instructions, or activities performed outside supervised sessions.
• Results vary between individuals and cannot be guaranteed.
• You participate in all sessions at your own risk.
• Physiotherapy and exercise physiology interventions are provided based on professional judgement but do not eliminate all risk.


Nothing in these Terms excludes rights under the Australian Consumer Law (ACL).

8. Clinical Disclaimer

• Physiotherapy and exercise physiology are not substitutes for medical care.
• We do not diagnose medical conditions unless performed by a registered physiotherapist within their scope.
• You must seek medical advice when appropriate.
• Emergency or acute medical issues must be directed to a GP or emergency services.

9. NDIS Disclaimer

• Access Ability is not an NDIS registered provider (unless this changes in future).
• We support self‑managed and plan‑managed participants only.
• We do not guarantee plan reviews, funding approvals, or reimbursement.
• Participants are responsible for ensuring services align with their plan goals and budgets.

10. Website Use

You agree not to:

• Copy or reproduce website content
• Misuse forms, booking systems, or contact details
• Attempt to breach website security


All content is protected by copyright and intellectual property laws.

11. Privacy & Data Handling

We comply with the Australian Privacy Principles (APPs).

Your personal and health information is collected for service delivery and stored securely.
