MOVE WELL SENIORS PROGRAM – TERMS & CONDITIONS

1. Program Description
The Move Well Seniors Program (“the Program”) is an online exercise, education, and support service delivered by Access Ability. The Program provides general exercise guidance for older adults, including videos, written resources, Telehealth sessions, and condition‑specific routines. The Program is not medical treatment, physiotherapy, or emergency care.
2. Medical Clearance & Safety
By joining the Program, participants confirm that they:
• Are medically stable and safe to exercise independently
• Have obtained medical clearance if they have chronic, complex, or unstable conditions
• Understand that exercise carries inherent risks, including the risk of serious injury or death
Participants agree to stop immediately if they experience pain, dizziness, shortness of breath, chest discomfort, or any unusual symptoms.
3. Not a Substitute for Medical Care
All information provided in the Program is general in nature and does not replace:
• Medical advice
• Diagnosis
• Treatment
• Physiotherapy
• Emergency services
Participants must consult their GP or specialist for medical decisions.
4. Participant Responsibilities
Participants agree to:
• Exercise within their own physical limits
• Use safe equipment and a clear exercise space
• Follow all instructions provided
• Take responsibility for their own safety during all sessions
Access Ability is not responsible for injuries caused by:
• Incorrect technique
• Unsafe environments
• Pre‑existing conditions
• Failure to follow instructions
• Participation against medical advice
5. Telehealth Sessions
Telehealth sessions are provided by an Accredited Exercise Physiologist and include general exercise guidance only. They do not constitute medical treatment or emergency care. Participants must ensure they are in a safe environment during Telehealth sessions.
6. Mobility Equipment Discount
Program members receive 20% off mobility equipment through approved suppliers.
Access Ability is not liable for:
• Product faults
• Delivery issues
• Incorrect sizing
• Misuse of equipment
All equipment purchases are between the participant and the supplier.
7. Payments, Refunds & Cancellations
• All payments are processed securely.
• Because the Program includes immediate access to digital content, fees are non‑refundable, except where required by Australian Consumer Law.
• Subscription programs renew automatically unless cancelled prior to the renewal date.
• Refunds are not provided for change of mind, non‑use, or inability to participate.
8. Intellectual Property
All videos, guides, icons, resources, and program materials are the property of Access Ability.
Participants may not copy, share, distribute, or reproduce any content.
9. Limitation of Liability (Including Injury or Death)
Exercise carries inherent risks, including the risk of serious injury or death.
By participating in the Move Well Seniors Program, you acknowledge and accept these risks.
To the maximum extent permitted by Australian law, Access Ability, its employees, contractors, and representatives are not liable for any injury, illness, aggravation of a pre‑existing condition, disability, or death arising from:
• Failure to follow instructions
• Unsafe exercise environments
• Incorrect or unsafe use of equipment
• Pre‑existing medical conditions
• Participation against medical advice
• Technical issues, internet outages, or inability to access the Program
• Misinterpretation of Program content
• Actions taken outside the scope of the Program
Participants engage in all exercise activities at their own risk and are responsible for ensuring they are medically safe to participate.
Nothing in these Terms excludes any rights or guarantees that cannot be excluded under Australian Consumer Law.
10. Privacy & Data Use
Personal information is collected for the purpose of delivering the Program.
Information is stored securely and not shared except where required by law.
Participants consent to being contacted regarding Program updates and support.
11. Acceptance of Terms
By joining the Program, participants confirm that they:
• Have read and understood these Terms & Conditions
• Accept all risks associated with exercise
• Agree to follow all safety instructions
• Understand the Program is not medical treatment
• Consent to the use of their information for Program delivery
